Terms of Service

Introduction

Welcome to BackcourtIQ. These Terms of Service (“Terms”) govern your access to and use of the BackcourtIQ website, web application, and any related services (collectively, the “Service”) operated by BackcourtIQ LLC (“BackcourtIQ,” “we,” “us,” or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and BackcourtIQ. Please read them carefully.

1. Who Can Use BackcourtIQ

You may use BackcourtIQ only if you meet all of the following requirements:

  • Age — You must be at least 16 years old. By creating an account, you confirm that you are 16 years of age or older. We chose 16 as our global minimum age to align with GDPR digital consent requirements in the European Union and to provide a consistent standard for all users regardless of location. We do not knowingly collect personal information from users under 16. If we discover that a user is under 16, we will terminate their account immediately and delete their data.
  • Legal capacity — You must have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
  • Compliance — You must not be prohibited from using the Service under applicable law, including laws of the United States or any other applicable jurisdiction.
  • Prior termination — You must not have had an account previously terminated by BackcourtIQ for a violation of these Terms.

2. Account Rules

When you create a BackcourtIQ account, you agree to the following:

  • One account per person — You may maintain only one account. You may not create multiple accounts or use another person's account. Accounts are for individual use only and may not be shared.
  • Accurate information — You must provide accurate, current, and complete information when creating your account. You are responsible for keeping your account information up to date. Providing false information, including a false name or age, is a violation of these Terms.
  • Account security — You are responsible for maintaining the security of your account credentials. You must not share your password with anyone. You must notify us immediately at contact@backcourtiq.com if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from unauthorized use of your account.
  • Account responsibility — You are responsible for all activity that occurs under your account, whether or not you authorized it.

3. Acceptable Use

BackcourtIQ is a platform for women's basketball fans. You agree to use the Service only for its intended purpose and in a manner consistent with all applicable laws and these Terms.

You may not use BackcourtIQ to:

  • Harass, threaten, bully, stalk, or intimidate any person
  • Post or transmit content that is abusive, hateful, discriminatory, or promotes violence against any person or group based on race, ethnicity, national origin, gender, gender identity, sexual orientation, religion, age, disability, or any other characteristic
  • Impersonate any person or entity, including any player, team, league official, or BackcourtIQ employee
  • Post or transmit any content that is defamatory, obscene, pornographic, or otherwise offensive
  • Post, share, or transmit content that infringes the intellectual property rights of any third party, including copyrights, trademarks, or publicity rights
  • Spam, advertise, or solicit other users without authorization
  • Post content that contains viruses, malware, or any code designed to disrupt or damage any system
  • Attempt to gain unauthorized access to any part of the Service or any other system
  • Scrape, crawl, or harvest data from the Service without our written permission
  • Use the Service for any illegal purpose or in violation of any applicable law
  • Coordinate or encourage others to violate these Terms

BackcourtIQ also maintains Community Guidelines that describe expected behavior in more detail. By using the Service you agree to follow the Community Guidelines, which are incorporated into these Terms by reference.

4. User-Generated Content

BackcourtIQ allows users to post content including community posts, comments, and live game chat messages (“User Content”). The following rules apply to all User Content.

4.1 Your ownership

You retain ownership of any original content you post on BackcourtIQ. We do not claim ownership of your User Content.

4.2 License you grant us

By posting User Content on BackcourtIQ, you grant BackcourtIQ a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, display, reproduce, distribute, modify, and create derivative works of your User Content in connection with operating and improving the Service. This license continues even if you delete your content or close your account, solely to the extent that copies may persist in backups or have been shared by other users.

4.3 Your representations

By posting User Content, you represent and warrant that: (a) you own the content or have the right to grant the license above; (b) the content does not violate these Terms, any applicable law, or the rights of any third party; and (c) the content is accurate and not misleading.

4.4 Ephemeral chat content

Live game chat messages are ephemeral. Chat messages are automatically and permanently deleted one hour after the associated game ends. You should not rely on chat messages being available after a game concludes.

4.5 Our right to moderate

BackcourtIQ reserves the right — but not the obligation — to review, monitor, moderate, remove, or refuse to display any User Content at any time and for any reason, including if we believe the content violates these Terms, our Community Guidelines, or is otherwise harmful to our users or the Service. We are not liable for any failure to remove content or for removing content you believe should not have been removed.

4.6 Enforcement and appeals

If we determine that your User Content or conduct violates these Terms, we may remove the content, issue a warning, suspend your account, or permanently terminate your account. We will use reasonable judgment in making these decisions. If you believe your content was removed or your account was suspended in error, you may appeal by emailing us at contact@backcourtiq.com within 30 days of the action. We will review appeals in good faith but our decisions are final.

5. Account Deletion and Data

5.1 Self-service deletion

You may delete your BackcourtIQ account at any time by navigating to Settings and selecting “Delete Account.” Account deletion is initiated immediately and is irreversible. We do not offer a recovery option after deletion is confirmed.

5.2 What gets deleted

When you delete your account, the following personal data is permanently and irreversibly deleted from our systems:

  • Your account record, including your name, email address, and authentication credentials
  • Your player follow preferences and notification settings
  • Any remaining chat messages not yet removed by the ephemeral cleanup process
  • All other personal data linked to your account in our database

Deletion is processed immediately upon confirmation. Residual copies may persist in encrypted backups for up to 30 days before those backups are overwritten, but your data will not be accessible or used during that period.

5.3 What is retained after deletion

When you delete your account, your community posts, comments, and all other personal data linked to your account are permanently deleted. Nothing is retained in anonymized form.

Aggregate, non-identifiable analytics data — such as page view counts or feature usage statistics that are not linked to your identity — may be retained indefinitely. This data cannot be used to identify you.

5.4 Effect of deletion on your rights

Deleting your account terminates your right to use the Service. You will be signed out immediately and will not be able to log back in. If you wish to use BackcourtIQ again after deleting your account, you will need to create a new account.

5.5 Deletion requests

If you are unable to delete your account through the Settings page for any reason, you may request deletion by emailing contact@backcourtiq.com. We will process your request within 30 days.

5.6 Content license after deletion

Deleting your account ends your right to use the Service and triggers the permanent deletion of your User Content as described in Sections 5.2 and 5.3. The license you granted BackcourtIQ under Section 4.2 terminates with respect to your deleted content, except to the extent that copies may persist in encrypted backups for up to 30 days before those backups are overwritten.

If you want to ensure specific content is removed, delete it individually before closing your account. Once your account is deleted, we cannot action individual content removal requests.

6. Intellectual Property

6.1 BackcourtIQ's intellectual property

The Service and all content, features, and functionality provided by BackcourtIQ — including but not limited to the design, text, graphics, logos, icons, images, data, software, and the selection and arrangement thereof — are owned by BackcourtIQ or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any BackcourtIQ content without our prior written permission.

6.2 WNBA and third-party content

BackcourtIQ displays publicly available data about WNBA games, players, and statistics. The WNBA, its teams, and related marks are the intellectual property of their respective owners. BackcourtIQ is not affiliated with, endorsed by, or sponsored by the WNBA or any WNBA team.

6.3 DMCA — copyright complaints

BackcourtIQ respects intellectual property rights. If you believe that content on the Service infringes your copyright, please send a notice to alyssa@backcourtiq.com with the following information: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

6.4 Aggregate data

BackcourtIQ may share aggregated, non-identifiable fan trend data with third-party partners, including brands, sponsors, media companies, and sports organizations, and we may receive compensation for doing so. This data describes patterns across groups of users and cannot be used to identify you as an individual. This is not a sale of your personal information. 7. Third-Party Links and Services

The Service may contain links to third-party websites, streaming platforms, or services (such as broadcast streaming links). These links are provided for your convenience only. BackcourtIQ does not control, endorse, or assume any responsibility for third-party content, services, or practices. Your use of third-party services is subject to the terms and privacy policies of those services. We are not responsible for the availability, accuracy, or content of any third-party service.

8. Disclaimers

8.1 As-is service

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BACKCOURTIQ DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No guarantee of availability

We do not guarantee that the Service will be available at all times, uninterrupted, or error-free. We may suspend or discontinue the Service or any feature at any time without notice. We are not liable for any loss or damage caused by downtime, errors, or interruptions.

8.3 Data accuracy

Game scores, statistics, schedules, and broadcast information displayed on BackcourtIQ are sourced from third-party data providers. While we make reasonable efforts to display accurate information, we do not guarantee the accuracy, completeness, or timeliness of any data. Do not rely solely on BackcourtIQ for time-sensitive sports information.

8.4 User content

BackcourtIQ does not endorse any User Content posted by users. We are not responsible for the accuracy, completeness, or legality of User Content. You access and rely on User Content at your own risk.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BACKCOURTIQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF BACKCOURTIQ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL BACKCOURTIQ'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO BACKCOURTIQ IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless BackcourtIQ and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

11. Termination by BackcourtIQ

BackcourtIQ may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service immediately ceases.

If you believe your account was terminated in error, you may appeal by emailing contact@backcourtiq.com within 30 days of the termination. We will review your appeal in good faith.

For voluntary account deletion by you, see Section 5. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

12. Changes to These Terms

BackcourtIQ may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top of this page, notify you by email to the address on file for your account, and display a prominent notice within the Service the next time you log in. Material changes will take effect 14 days after notice is provided. Your continued use of the Service after that 14-day period constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service before the effective date. You may delete your account at any time through Settings.

Non-material changes — such as clarifications, typo corrections, or updated third-party links — may take effect immediately without prior notice.

13. Governing Law and Dispute Resolution

13.1 Governing law

These Terms and any dispute arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflict of law principles.

13.2 Dispute resolution

Before filing any formal legal claim against BackcourtIQ, you agree to first attempt to resolve the dispute informally by contacting us at contact@backcourtiq.com with a written description of the dispute, the relief you are seeking, and your contact information. We will acknowledge your notice within 5 business days and attempt to resolve the dispute within 30 days of receipt.

You agree that this informal resolution process is a prerequisite to filing any formal claim. If the dispute is not resolved within 30 days — or such longer period as the parties agree in writing — either party may pursue the remedies available under Section 13.3.

Both parties agree to negotiate in good faith during this period. The statute of limitations and any filing fee deadlines applicable to your claim will be tolled during the informal resolution period.

13.3 Jurisdiction

If a dispute cannot be resolved informally, you agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Virginia for any legal proceedings arising out of or related to these Terms or the Service.

13.4 Class action waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

14. Miscellaneous

  • Entire agreement — These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and BackcourtIQ regarding the Service and supersede all prior agreements.
  • Severability — If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • No waiver — Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to enforce it in the future.
  • Assignment — You may not assign or transfer these Terms or any rights under them without our prior written consent. BackcourtIQ may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
  • No third-party beneficiaries — These Terms do not create any third-party beneficiary rights.
